Terms of Service

These terms govern the services provided by THE GROWTH LINE LLC, a Wyoming limited liability company, referred to here as we, us or the Company. By engaging us or using this website you agree to these terms.

Services

We provide marketing, website development, search, and automation services. The specific work, deliverables, timeline and fee for any engagement are set out in a written proposal or statement of work agreed with you before work begins. That document takes precedence over these terms where the two differ.

Quotes and fees

Fees are quoted per engagement. Project work is quoted at a fixed price against a fixed scope. Retainers are billed monthly in advance. Audits and consultations are quoted as a single fee. All prices are in United States dollars unless the proposal states otherwise.

Payment

Project work generally requires a deposit before work begins, with the balance due on delivery. Retainers are invoiced monthly. Invoices are payable within fourteen days of issue unless agreed otherwise in writing. We may suspend work on overdue accounts after written notice.

Your responsibilities

You agree to provide the access, materials, approvals and feedback the work requires, and to do so in reasonable time. You confirm that any content, logos or data you supply are yours to use and do not infringe the rights of others. Delays caused by missing materials or approvals may move agreed deadlines.

Ownership

On full payment, ownership of the final deliverables produced specifically for you transfers to you. We retain ownership of our own tools, frameworks, templates and general know how, and of any third party components which remain subject to their own licences. We may describe the work in our portfolio unless you ask us in writing not to.

Third party services

Engagements often involve third party platforms such as advertising networks, hosting providers, email services and analytics tools. Those services are governed by their own terms, are billed separately unless stated otherwise, and are outside our control.

Results

We apply professional skill and care. We do not guarantee any specific ranking, traffic level, conversion rate, revenue figure or advertising outcome, because those depend on factors outside our control including platform behaviour, market conditions and your own operations.

Confidentiality

Each party agrees to keep the other party’s non public business information confidential and to use it only for the purpose of the engagement.

Limitation of liability

To the fullest extent permitted by law, our total liability arising from an engagement is limited to the fees you paid us for that engagement in the three months preceding the claim. We are not liable for indirect, incidental or consequential losses, including lost profits or lost data.

Termination

Either party may end a retainer with thirty days written notice. Either party may end a project engagement with written notice if the other party materially breaches these terms and does not remedy the breach within fourteen days. On termination you pay for work completed up to the termination date.

Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules.

Changes

We may update these terms. The version in force for your engagement is the version published on the date your proposal was signed.
